Terms and Conditions

Using the website and placing orders

These Terms apply to purchases from Natali Art Hub, operated by Dnyanesh K Mhatre, sole proprietor trading as Natali Enterprise. Supply is limited to India. The Additional Contract Terms below form part of these Terms. By placing an order, you accept these Terms and the applicable Shipping, Cancellation, Returns and Refunds policies displayed before purchase. You must be at least 18 and legally able to enter into a contract. A parent or guardian must place orders for a minor.

Provide correct contact, delivery and billing information. Keep account access secure and inform us if you suspect unauthorised use. Do not use the website for fraud, unlawful content, interference with its operation or infringement of another person’s rights.

Order acceptance and availability

An automated order acknowledgement confirms receipt of your request. Acceptance occurs when we issue a separate acceptance or dispatch confirmation. If stock is unavailable, payment cannot be verified, delivery is not possible or a material listing error is identified before acceptance, we will contact you and offer a correction for your agreement or cancellation with a refund of the amount collected. We will not substitute products without your consent.

Special orders, custom sizes and pre-orders must show their specifications, expected timing, payment terms and any permitted change-of-mind restrictions before you commit. General terms do not authorise us to change an accepted order unilaterally.

Descriptions prices and offers

We aim to provide accurate descriptions and images. Screen colour and normal manufacturing differences may affect appearance, but this does not excuse a material mismatch with the description or a defective product. Check size, quantity, shade and pack contents before purchase; ask us if anything is unclear.

Retail product prices are in Indian rupees and include applicable taxes unless a clearly identified business quotation states a lawful separate tax treatment. Shipping and other disclosed charges, if any, are shown before payment. MRP is the maximum retail price where applicable and is not automatically our former selling price. Offer terms state eligibility, duration, exclusions and whether offers can be combined.

Rights responsibility and disputes

We remain responsible for obligations that apply to us as the seller. Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including applicable consumer and product-liability rights. A manufacturer warranty is additional to those rights.

These Terms and transactions are governed by the laws of India. Subject to mandatory statutory jurisdiction, courts of competent jurisdiction at Mumbai, Maharashtra, shall have exclusive jurisdiction over disputes arising out of or connected with the website, these Terms or a transaction, provided those courts otherwise have jurisdiction under law. This clause does not exclude any consumer commission, statutory authority or other forum whose jurisdiction cannot lawfully be excluded, including a consumer’s right to file where permitted by the Consumer Protection Act, 2019.

Website content and brand materials belong to their respective owners. Access to the website does not transfer intellectual property rights. We may update these Terms prospectively; the version applicable when an order was placed continues to govern that order unless law requires otherwise or the parties agree to a lawful change.

Domestic supply and customer details

Our sales service is for delivery within India only. Imported brands offered on the website are supplied domestically; their origin does not mean we offer international shipping. Give a correct recipient name, Indian delivery address, PIN code and reachable contact number. We may decline an unserviceable order before acceptance and promptly refund any amount collected. An overseas address must not be disguised as an Indian address.

Payment verification and order security

Use a payment method you are authorised to use. We verify payment through our bank or payment provider; a screenshot alone does not establish receipt. Where reasonably needed, we may request proportionate information to verify a suspicious order or pause dispatch while checking it. We will explain any material delay and resolve the order or refund it as required. Verification will not be used to retain customer money indefinitely.

Delivery attempts and customer caused damage

If delivery fails because the address supplied is incorrect or the recipient is unavailable, we will contact you about redelivery or cancellation. Any additional reasonable freight must be disclosed and agreed before charging it. Refusing a visibly damaged or incorrect parcel is not, by itself, abuse. Delivery acknowledgements are evidence of receipt, not a waiver of defects discovered later.

We may decline a claim to the extent reliable evidence shows that the reported damage was caused after delivery solely by misuse, incompatible mixing, unauthorised alteration or storage contrary to supplied instructions. We will explain the evidence and reasons. This does not exclude a pre-existing defect, inadequate warning, inaccurate description or responsibility imposed on us by law.

Abuse and legitimate complaints

Do not submit false orders, fabricate payment or return evidence, substitute products in a return, misuse another person’s identity or interfere with the website. On reasonable evidence of abuse, we may restrict future orders or account access and pursue lawful remedies. Any action will be proportionate and will preserve valid existing orders, refunds and access to complaints. Honest negative reviews, statutory complaints and legitimate chargebacks are not abuse.

Events outside reasonable control

If a natural disaster, government restriction or comparable event beyond reasonable control prevents performance, we will notify affected customers, take reasonable steps to reduce the impact and explain revised options. Ordinary stock errors or preventable operational failures are not automatically such events. We will not keep payment for an order we cancel or cannot fulfil. This clause does not override mandatory refund rights or allow indefinite postponement without a lawful basis.

Consistent terms and enforceability

Specific product promises and lawful terms agreed before purchase remain binding. A later invoice, website edit or internal policy cannot retrospectively remove them. If a provision is held invalid, it will apply only to the extent lawful or be severed where legally possible; the remaining provisions continue where capable of doing so. A delay in enforcing a right is not by itself a waiver. Nothing shortens statutory limitation periods or prevents urgent or mandatory legal remedies.
